Vendor Agreement and Information

It is agreed:
  1. Vendor’s staff may exhibit goods which are for sale only while the staff is within the area of the Vendor’s specified location.
  2. Vendor’s staff (Adult presence required) will be properly dressed and their appearance will be clean and neat and they shall conduct themselves in an orderly fashion.
  3. There is to be no loud distracting music, noise, and or sound amplification devices used by the Vendor’s staff at the event.
  4. Vendor shall leave the location free from trash and in similar condition that it was in before the Vendor presence. Vendors must haul out their own trash.
  5. Vendor agrees to hold IFWEF free from any damages or claims that may develop in connection with participating in the above mentioned Event.
  6. Vendors cannot promote political candidates or political agendas at the Event.
  7. No dogs allowed at the event except for Registered Service Dogs. Documentation required.
  8. No alcoholic beverages to be consumed during the event.


FOOD VENDORS MUST SEND A COPY OF THEIR FOOD PERMIT AND FOOD HANDLERS CARD WITH THEIR APPLICATION AND HAVE IT ON SITE AT THE FESTIVAL.
The terms and conditions to be kept in mind by the vendor before starting business are:


HOURS OF OPERATION: 8 AM to 3 PM Saturday and Sunday.


The vendor will provide their own tent and/or awning (weights recommended), display tables and chairs. No electricity is provided. Space locations will be assigned by IFWEF.
IFWEF is not responsible for damage done due to inclement weather. IFWEF accepts no liability for lost, stolen or damaged property.
Friday and Saturday nights, a volunteer from IFWEF will stay overnight to secure the vendor area. Vendors need to secure any items left on the premises overnight from wind or weather. While we will do our best to ensure the safety of materials left overnight, we are not responsible for loss due to theft or damage that might occur.
Cancellation:
By vendor – the Vendor may cancel this agreement at any time. If the Vendor cancels before June 15, the Vendor will receive a full refund. If the Vendor cancels between June 15 – July 15, a 50% refund will be issued. If the Vendor cancels 0-10 days before the event, the Vendor will not receive a refund unless documentation is presented to IFWEF from a physician or licensed health care employee excusing the Vendor due to an emergency health situation.
By IFWEF – IFWEF may cancel this Agreement at any time. If IFWEF cancels, all monies previously paid by the Vendor will be refunded, with the exception of any non-refundable deposits, which were agreed to by the Vendor.
The vendor fee of $50.00 for a 10’ x 10’ space for two days should be paid at the time you submit your registration form. No cash please. Checks made payable to Imogen F Wilson Education Foundation or IFWEF, along with the Donation Form and signed Vendor Form, may be mailed to PO Box 307, Mimbres, NM 88049.


Payment may be made on the website http://www.mimbrescultureheritagesite.org. Choose the DONATE button at the top of the page which will take you to a secure SQUARE link. Enter your Payment Amount * Select One-Time * Checkout * Fill in identifying information * Complete Payment * Print the Authorization Code from your Receipt on the Signature Line below, and email this form to [email protected].


Checks or credit cards, with the signed vendor form, can be accepted by stopping in the museum at 12 Sage Drive, Mimbres, NM, on Saturdays or Sundays 11 AM – 3 PM.

On behalf of the entire group participating in the Hummingbird Festival I assume all risk of bodily injury, property damage, and personal injury that may occur by participating in the festival for myself/ourselves, heirs, executors and administrators, do hereby forever waive and release any and all claims against and agree to hold harmless the Imogen F Wilson Education Foundation. Its committee, sponsors and volunteers, with their respective officers, employees, agents, representatives, volunteers, successors or assigned any kind from any and all claims which may be made for any cause whatsoever arising as a result of participation. Further I hereby consent to allow my picture or likeness to appear in any official document, news release, sponsor advertisement and/photographic portraits, or pictures, video tape or film of me in which I may be included in whole, part, composite or reproductions of thereof in black and white and/or color or otherwise made through any media now known, for art, advertising trade or any other similar, lawful purposes whatsoever, including the publicity of this event itself, excluding commercial use of or by marketing sponsors.
